The search of transfer spirit of consensual sale and purchase: An ancient instrument in Latin American legal culture for promoting the common trade. (English)

This article develops an historical investigation that aims to revel the consensual characteristic of the sale and purchase contract and its influence in the way we theoretically conceive the phenomenon of the transfer of property in the western legal culture sphere, in order to promote unification between 'solo consensu' technique and 'title and mode' system. Situation that ultimately will contribute to the improvement of the trade relations of countries that share an ancestral kinship derived from Roman law. [ABSTRACT FROM AUTHOR]

Este trabajo pretende develar históricamente la característica consensual del contrato de compraventa y su influjo en la forma de concebir teóricamente el fenómeno de la transferencia de la propiedad en el ámbito de la cultura jurídica occidental, con el fin práctico de promocionar la unificación de la técnica del 'solo consensu' y la teoría romanista del título y el modo, situación factible que a la postre contribuirá ostensiblemente al mejoramiento de las relaciones comerciales de aquellos países que hoy comparten un ancestral parentesco derivado del derecho romano.
