The issue of this essay is the institution of pacta in Roman Law and its evolution in Byzantine Law. Pacta was a very important institution in Roman Law of obligations which concerned all the informal - not prohibited by law - contracts, which were not enforceable by action, but would just create natural obligation. In the first part of the essay, there is a definition of pacta and a separation between pacta and another important institution in Roman Law, contracta, which were enforceable by action. In the second part there is a presentation of pacta during Roman Law. In particular there is a reference in the nature of pacta and the legistlative drafting status of the institution as well as a presentation of the evolution of the institution during the period of Roman Law. In particular, after the establishment of some pacta as enforceable by action, all the categories of pacta (pacta adiecta, pacta praetoria, pacta legitima and pacta nuda) are presented one by one. In the third part there is a presentation of pacta in Byzantine Law through references in texts of Byzantine Law and there is an effort to identify similarities and differences between pacta in Roman Law and pacta in Byzantine Law. The essay is completed by an overall assessment of the institution of pacta and the conclusions about the application and the evolution of this institution are presented.
